By accessing or using Clima Alerts (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.We reserve the right to update these Terms at any time. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
2. Description of Service
Clima Alerts provides a satellite-data-driven platform for monitoring methane emissions. Users may define geographic watch zones and receive notifications via email or WhatsApp when emission events are detected within those zones.Detection data is sourced from publicly available NASA EMIT and ESA Sentinel-5P satellite programmes. We process and interpret this data to generate alerts, but we do not originate or control the underlying satellite observations.
3. Accounts and Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.You agree to provide accurate, current, and complete information during registration and to keep it up to date.You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. WhatsApp Notifications and Opt-In
By providing and verifying a phone number for WhatsApp alerts, you expressly consent to receive automated messages from Clima Alerts via the WhatsApp Business platform.You may opt out at any time by replying STOP to any message or by removing your WhatsApp delivery method from the dashboard. Opting out will not affect other types of notifications.Standard message and data rates from your carrier may apply. Clima Alerts is not responsible for carrier charges.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms.You may not: (a) attempt to reverse engineer, decompile, or extract source code from the Service; (b) use automated scripts to scrape or overload the platform; (c) use the Service to transmit harmful, fraudulent, or illegal content; (d) impersonate another person or entity.Violation of these restrictions may result in immediate suspension or termination of your account without notice.
6. Data Accuracy and Limitations
The Service relies on satellite observation data that may be subject to processing delays, atmospheric interference, sensor limitations, or data gaps. Detection coverage and timeliness are not guaranteed.Clima Alerts is an informational tool and should not be used as the sole basis for regulatory compliance, emergency response, legal proceedings, or safety-critical decisions.We make no warranty that every emission event within a watch zone will be detected or that all alerts will be delivered on time.
7. Intellectual Property
All software, design, algorithms, and content comprising the Service are the intellectual property of Clima Alerts or its licensors. Nothing in these Terms grants you ownership of any part of the Service.You retain ownership of the watch zone configurations and settings you create. By using the Service, you grant us a limited licence to process that data to operate the Service on your behalf.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLIMA ALERTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
10. Indemnification
You agree to indemnify and hold harmless Clima Alerts and its officers, directors, employees, and contractors from any claims, damages, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
You may close your account at any time from the dashboard or by contacting us.We reserve the right to suspend or terminate access to the Service at our discretion, including for breach of these Terms, extended inactivity, or legal requirements, with or without notice.Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 9, and 10 survive termination.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Clima Alerts is registered, without regard to its conflict of law provisions.Any disputes arising under these Terms shall be resolved through binding arbitration or, where arbitration is not permitted, in the courts of the applicable jurisdiction.
